These Terms and Conditions apply when you visit our website or purchase products from TALO.

  1. ACCEPTANCE OF THESE TERMS

By using this website, you agree to these Terms and Conditions and our Privacy Policy.

By placing an order, you confirm that:

• the information you provide is accurate and complete;• you have the legal capacity to enter into the transaction; and• you have reviewed your order, delivery information and total cost before submitting payment.

Nothing in these terms removes or limits any rights granted to consumers by South African law.

  1. PRODUCTS

We take reasonable care to describe and photograph our products accurately. Colours, textures and appearance may differ slightly between batches or from what is displayed on a screen.

TALO products are handcrafted in small batches using natural ingredients. Minor variations in colour, texture, scent or consistency are normal and are not necessarily defects.

Tallow products may soften or melt when exposed to heat. This does not necessarily affect their quality. Allow the product to return to a cool room temperature before use.

All products are subject to availability.

  1. PRODUCT USE AND SKIN SENSITIVITY

Please read the product label and ingredient list before use.

TALO skincare products are intended for external use only. Perform a patch test before using a product more widely. Stop using the product if irritation or an adverse reaction occurs.

Do not use a product if you are allergic or sensitive to any listed ingredient. Seek advice from an appropriate healthcare professional if you are pregnant, breastfeeding, receiving medical treatment or uncertain whether a product is suitable for you.

Product information on this website is provided for general information and is not intended to diagnose, treat, cure or prevent a medical condition.

  1. PRICES AND PAYMENT

All prices are displayed in South African rand.

TALO is not currently registered for VAT, and VAT is therefore not added by TALO to product prices.

The complete amount payable, including delivery charges, will be displayed before you submit your order.

Payments are processed through the payment methods made available at checkout. TALO does not directly store complete payment-card details.

  1. ORDERS

An order is accepted once payment has been confirmed and an order confirmation has been issued.

We may decline or cancel an order if:

• payment cannot be confirmed;• a product is unavailable;• the price or product information contained an obvious error;• we reasonably suspect fraud or misuse; or• we cannot deliver to the address provided.

If we cancel a paid order, we will notify you and refund the amount paid.

If a product becomes unavailable after an order is placed, we will contact you and offer an appropriate replacement or a refund.

  1. DELIVERY

TALO currently delivers within South Africa only.

The applicable nationwide courier charge is displayed during checkout.

The estimated delivery period is 2 to 5 working days after dispatch. Weekends and South African public holidays are not counted as working days.

Delivery periods are estimates. Courier delays, severe weather, remote-area delivery and other events outside TALO’s reasonable control may affect delivery.

Customers must provide a complete and accurate delivery address and contact number. Additional courier charges caused by an incorrect or incomplete address may be charged to the customer where legally permissible.

Risk in the products passes to the customer when the order is delivered to the customer or an authorised recipient at the delivery address.

  1. ORDER CANCELLATIONS

Contact TALO as soon as possible if you wish to cancel an order.

An order that has not yet been dispatched may be cancelled and refunded.

If the order has already been dispatched, it will be handled under the returns provisions below.

TALO will execute orders within the period agreed during checkout or otherwise within the period required by South African law. If we cannot do so, you will retain your applicable cancellation and refund rights.

  1. CHANGE-OF-MIND RETURNS

Where applicable under the Electronic Communications and Transactions Act, a customer may cancel an online purchase within seven days after receiving the goods.

The customer is responsible for the direct cost of returning a change-of-mind purchase.

To qualify for a change-of-mind return, the product must be unused, unopened, unaltered and returned with its original seal, label and packaging intact.

For health and hygiene reasons, we cannot accept a change-of-mind return of skincare that has been opened, unsealed or used. This does not affect a customer’s rights where a product is defective, unsafe, damaged or incorrectly supplied.

Please contact TALO before sending a return so that we can provide return instructions.

  1. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

Please inspect your parcel as soon as it arrives.

If an order arrives damaged, leaking, defective or incorrect, contact us as soon as reasonably possible. Please include your order number and clear photographs of the parcel, packaging and product where possible.

If a product does not meet the quality standards required by the Consumer Protection Act, the customer is entitled to the remedies provided by law. Depending on the circumstances and the customer’s lawful choice, this may include a replacement or refund.

TALO will cover reasonable return costs where we supplied an incorrect, unsafe or defective product.

Reporting courier damage within 48 hours helps us investigate the claim promptly, but this request does not remove any statutory consumer rights.

  1. REFUNDS

Approved refunds will be made through the original payment method where reasonably possible.

Banks and payment providers may require additional processing time before a refund appears in the customer’s account.

Any refund will be processed within the period required by applicable South African law.

Original delivery charges are not normally refunded for a change-of-mind return unless required by law. Delivery and reasonable return costs will be refunded where TALO supplied an incorrect or defective product and the law requires TALO to bear those costs.

  1. WEBSITE USE

You may use this website for lawful personal shopping and informational purposes.

You may not:

• interfere with the operation or security of the website;• attempt to gain unauthorised access to any system or account;• copy or commercially exploit website content without permission;• submit false, fraudulent or harmful information; or• use the website in a manner that violates applicable law.

  1. INTELLECTUAL PROPERTY

The TALO name, logo, product photographs, product descriptions, label designs and original website content belong to TALO or are used with the relevant owner’s permission.

They may not be copied, reproduced, modified or used commercially without written permission.

Third-party names, trademarks and payment logos remain the property of their respective owners.

  1. PRIVACY

We collect and process personal information to manage orders, payments, delivery, customer enquiries and our legal obligations.

Further details are contained in our Privacy Policy, which forms part of these terms.

Customers may contact us to request access to or correction of their personal information, subject to applicable law.

  1. LIABILITY

TALO will exercise reasonable care in operating this website and supplying its products.

To the fullest extent allowed by law, TALO is not responsible for losses caused by:

• misuse of a product or failure to follow its label instructions;• an ingredient sensitivity that was not disclosed to or reasonably foreseeable by TALO;• inaccurate information supplied by the customer;• events outside TALO’s reasonable control; or• unlawful interference with the website by a third party.

Nothing in these terms excludes or limits liability or consumer rights where doing so would be unlawful.

  1. COMPLAINTS AND DISPUTES

Please contact TALO first if you are dissatisfied with an order. We will make a reasonable effort to investigate and resolve the matter fairly.

Nothing in these terms prevents a customer from exercising rights or approaching an appropriate consumer protection authority under South African law.

  1. CHANGES TO THESE TERMS

We may update these terms when our products, services, delivery arrangements or legal obligations change.

Changes will be published on this page and will apply to future website use and future orders. The terms applying when an order was placed will continue to govern that order.

These terms are governed by the laws of the Republic of South Africa.
